The rule most Australians know is correct: gambling winnings are not taxed. The rule most Australians do not know is the exception attached to it — that the exemption depends on gambling being a pastime rather than a business, and that the Australian Taxation Office decides which it is by looking at how you operate, not at how much you win.

Almost nobody crosses that line. But the people who wonder whether they have crossed it are usually the ones for whom the question is live, and the answer is not "how much did you win".

The general position
The starting point is that a gambling win is not income. Betting and gambling proceeds are the result of chance rather than of earning activity, and Australian tax law does not treat them as assessable income for an ordinary punter.
The symmetry matters as much as the rule. Because winnings are not assessable, losses are not deductible. You cannot offset a bad year against your salary, and the expenses of gambling — subscriptions, data, travel, equipment — are not deductible either. The exemption is a package, and it cuts both ways.
This position covers essentially everyone: the casual punter, the regular weekend player, and the person who has an unusually good year. A single large win does not change the character of the activity.
Where the line actually sits
The exemption falls away if the gambling amounts to carrying on a business. This is not a threshold you cross by winning a certain amount; it is a characterisation of the activity as a whole.
The indicators the ATO applies to gambling are the same ones it applies to any activity said to be a business, and no single one is decisive. In broad terms, they ask:
Is the activity organised and businesslike? Systematic records, a defined method, accounting for results, operating to a plan rather than to inclination.
Is it conducted on a scale, and with a regularity, that resembles a trade? Frequency and volume, sustained over time rather than in bursts.
Is skill involved, and is the punter applying it professionally? Games with a material skill component, engaged with as a skilled practitioner would.
Is the activity a principal source of income, pursued rather than incidental?
Is there capital committed, and infrastructure behind it? Dedicated funds, software, staff, premises.
Why almost no one meets it
Read that list against ordinary casino play and the mismatch is immediate. Casino games carry a built-in house edge. There is no method that turns a negative-expectation game positive over time, which means the central indicator — a genuine, rationally based expectation of profit — cannot be satisfied.
The ATO has historically treated even very substantial, very regular gambling as a pastime, precisely because the absence of an edge means the activity cannot be a business no matter how organised or how large. Winning a great deal does not demonstrate a business; it demonstrates variance.
The realistic candidates are narrow: activities where an edge genuinely exists and is systematically exploited, conducted with the organisation and scale of a trade. That is a small population, and the people in it generally know it.
What this means in practice
A large win is not a taxable event. There is nothing to declare and no form to complete. The money is yours, in full, and its arrival in your bank account creates no tax consequence.
Gifting it has consequences for the recipient's affairs, not yours. Australia has no gift duty, but large transfers can raise questions elsewhere, and money given away can still be relevant to means-tested payments.
Your bank will report large transactions. Cash transactions above the reporting threshold are reported to AUSTRAC as a matter of course. This is anti-money-laundering reporting, not tax reporting, and it is not evidence that you owe anything. But it does mean a large, unexplained deposit can attract questions, and being able to document where it came from is worth the effort.
Keep the documentation. Not for a tax return, but for the conversation you may have with a bank or a lender. Withdrawal confirmations, account statements from the operator, and the dates and amounts involved are the record that turns an unexplained deposit into an explained one.
If you think the question might apply to you
If your gambling genuinely has the characteristics above — an identified edge, organised operation, real scale, profit as the purpose rather than the hope — the consequences run both ways. The winnings become assessable, and the losses and expenses become deductible. It is not automatically a worse outcome, and it is not something to decide alone.
That is a conversation for a registered tax agent, with your actual records in front of them. Nothing general can substitute for it, because the determination depends entirely on the particular facts of how you operate.
For everyone else, the position is the simple one: the win is not taxed, the loss is not deductible, and the only thing you need to declare is what the money earns after it arrives.
